This volume fills a gap in the literature regarding questions around the interactive dynamics between law and diplomacy on international trade and investment. It brings together lawyers and political scientists from Europe and Asia in an interdisciplinary effort at tracing the respective roles of law and diplomacy in the relations of the European Union (EU) with its trade and investment partners in Asia. Focusing on trade and investment relations with Asia, the EU presents a particularly interesting case as it has been a strong proponent of a rules-based international economic order for years and a frequent user of the formal procedures established in international treaties in case of disputes. At the same time, it has kept diplomatically active to adjust dispute management and international agreements to the needs and demands of the partners involved. Furthermore, not only is this region of crucial importance due to the presence of both vigorous emerging economies, like China, India and Vietnam, and more established partners, like Japan, EU-Asia relations also present a broad set of economic disputes and recent negotiation efforts analyzed in the contributions to this volume. This book highlights the emerging bidirectional interactions between Europe—primarily the EU—and Asia in the fields of political economy, development, environmental policy, security, diplomacy, and inter-institutional relations within the context of two recent global trends: the rise of China and the growing withdrawal of the U.S. from multilateral commitments. The volume incorporates nine different aspects and dimensions of Asian-European relations. In recent decades, Asia has (re-)gained rising importance on the world stage, which also entails closer interconnections with Europe. In an age of receding American global leadership and reduced commitments to its European allies, the EU and its member states have increasingly become more open to seeking and considering new partnerships. The rising economic prowess of Asia has made it of particular interest for European states. The book’s focus lies on potential challenges and opportunities in the bidirectional interactions between European and Asian states and institutions.

Delving into export restrictive measures this book links the key areas of WTO law, public international law, investment and competition law to expose how and why WTO rules on export dimension are insufficient due to export bias; how public international law helps to justify their adoption or maintenance; and how investment and competition laws contribute to their regulation. Built on works on accession protocols and national security exceptions, this book goes beyond international trade law and looks into international political economy, competition and investment law. It contributes to debates in conceptualising public and private forms of export restrictions, appreciating the complementary nature of trade and competition law in disciplining them; capturing the dynamic between trade and investment policies for their effectuation and circumvention; and bridging trade law and public international law to better understand their impositions for political and diplomatic purposes with the invocation of the national security justification.

The EU’s interest in and engagement with North East Asia has grown massively over the last three decades, the shaping and implementation of its policy influenced heavily by the UK and its historical links with East Asia. Brexit therefore raises questions about the future of this engagement and comes against a background of wider threats to the liberal world order, especially rising tensions between the USA and China. Worried that they may be forced to choose sides in their hitherto carefully managed relationships with the two, China’s neighbours are therefore watching with interest to see how the EU and the UK respond and manage their future relations with the region. This book goes beyond the traditional trade links to consider diplomatic and security perspectives, as well as wider issues such as the possible impact on educational and research links. This book offers comprehensive coverage of various aspects of financial accountability around the EU budget – how it is spent via policies, how institutions engage in checking policy performance (what taxpayers’ money actually delivers), and therein, the issues of monitoring, controlling, auditing, scrutinising and communicating budgetary expenditure. Presenting conceptual and theoretical approaches including financial accountability, learning, multi-level governance, implementation and throughput legitimacy, it looks at EU institutions (European Parliament, European Court of Auditors, European Ombudsman, European Public Prosecutor’s Office) and national bodies (supreme audit institutions at the national level), examining their contact with the EU budget. It details the historical development of accountability mechanisms (the ‘statement of assurance’, financial corrections, and parliamentary oversight by the Budgetary Control Committee (CONT)), and examines policy areas such as those of agriculture, social policy and cohesion (including Structural Funds and the Common Agricultural Policy), exploring the challenges of financial accountability in practice. Given the recent introduction of non-budgetary financial instruments and tools only partly financed by the EU budget, it sheds light on new burgeoning areas such as the European Stability Mechanism (ESM) and the European Fund for Strategic Investment (EFSI) and the challenges they bring for ensuring the accountability of public money. This book provides a timely evaluation of the EU’s ability to act internationally and coordinate policy in a time when it also seeks to meet shifting demands of international cooperation. These include global sustainable development, the challenge of multilateralism and the changing geopolitical order. Analysing the networks of officials and policy professionals in EU development policy, the book yields theoretical insights into dominant processes that characterise EU governance in international cooperation and assesses their role for policy coordination. Overall, this book concludes that EU policy coordination evades intergovernmental control and demonstrates how the agency of EU institutions depends on efforts of member state officials to defend their priorities and identities. Informed by and against the backdrop of the 2019 European Parliament (EP) elections, this innovative book provides a critical assessment of where Europe stands in terms of the quest to achieve democratic legitimacy. Since the 2014 EP elections, the European Union (EU) has experienced multiple crises, which arguably have undermined its legitimacy.
